Man who consumed 12 alcoholic drinks, then killed wife in Byron DUI crash takes plea deal, 10-year prison term

MARTINEZ — A Tracy man has accepted a 10-year prison term in connection with the July drunk driving crash that killed his wife on Byron Highway, court records show.

Andre Avaloz, 36, accepted convictions on gross vehicular manslaughter and drunk driving charges, just five months after prosecutors charged him with a DUI murder in the death of 38-year-old Anna Avaloz. According to police, Andre Avaloz admitted to officers he’d had 12 alcoholic drinks at a bar in Byron before the crash, and that he and his wife left the bar after he got into an altercation with another patron.

Authorities say Avaloz was driving about 85 mph when he lost control of his Chevrolet Suburban at about 11 p.m. and crashed into a drainage ditch near Clifton Court Road, injuring himself and killing his wife. Avaloz was briefly hospitalized.

On Dec. 21, Avaloz accepted the plea deal. He is set to be formally sentenced to 10 years on Jan. 9.

An online fundraiser for Anna Avaloz describes her as a mother of seven whose death left a “huge void” in the family.

“Anna did the work of 20 people for this very large household. She worked a full time job all while ensuring that her babies made it to school, sports practices, programs and any extracurricular activities,” the fundraiser says. “She used her free time to ensure that all of the children got to go somewhere fun and experience new things.”
