Man arrested in Oakland homicide charged with evading police on motorcycle, not involvement in shooting

OAKLAND — A man who was arrested in connection with a Dec. 26 homicide in East Oakland has been charged with evading police on a motorcycle immediately after the shooting, but faces no murder or manslaughter charges, court records show.

The 30-year-old man was arrested the same day as the Dec. 26 killing of 34-year-old Demarcus Banks, who was shot dead on the 1400 block of Sunshine Court near International Boulevard. Police wrote in court records that the suspect ran multiple red lights and drove against traffic while attempting to escape officers, who eventually arrested him near Interstate 880 and 66th Avenue.

Video that police later recovered from a Sunshine Court home showed Banks firing at a man, who returned fire with his own pistol before fleeing the area, authorities said. When investigators interviewed the 30-year-old suspect, he reportedly denied any involvement in the homicide and said he sped off on his motorcycle because he was scared of the police.

Prosecutors charged him with a felony count of evading police three days later. He has prior convictions for attempted murder and assault with a deadly weapon, court records show.
